
Terms and Conditions
By contacting Dee Dee Book Covers ("I", "me", "my") or by purchasing any of my services, the Client acknowledges that they have read, understood, and agreed to these Terms & Conditions.
These Terms & Conditions apply to all projects unless otherwise agreed in writing.
1. Availability & Project Schedule
Dee Dee Book Covers operates on a scheduled booking basis.
A booking is considered confirmed once the Client has submitted the design brief and both parties have agreed upon a project start date.
While every effort is made to meet the agreed project timeline, all delivery dates are estimates. Timelines may occasionally be adjusted due to project complexity, revision requests, client response times, illness, emergencies, holidays, or other circumstances beyond reasonable control.
Should any significant delay occur, the Client will be notified as soon as reasonably possible.
2. Booking Process
Before work begins, the Client is required to complete the design brief and provide all necessary information required for the project.
The accuracy and completeness of the information provided by the Client are the Client's responsibility.
Incomplete or delayed information supplied by the Client may affect the project timeline.
3. Payment
No deposit is required to begin a project.
Once the design brief has been received and the project has been scheduled, Dee Dee Book Covers will begin creating the initial cover design.
The Client will first receive one or more low-resolution design proposals containing the Dee Dee Book Covers watermark for review.
Once the Client approves the final eBook cover artwork, an invoice will be issued through PayPal.
Payment is accepted exclusively via PayPal unless otherwise agreed in writing.
Final high-resolution files, print-ready files, and any other deliverables included in the purchased package will only be supplied after full payment has been received.
Until full payment has been received, all artwork, concepts, drafts, previews, and design files remain the exclusive intellectual property of Dee Dee Book Covers.
4. Design Revisions
Each design package includes up to four (4) rounds of major revisions, unless otherwise stated.
Minor adjustments requested during each revision round are included.
Additional revisions beyond those included in the selected package may be accepted at the sole discretion of Dee Dee Book Covers and may incur additional charges.
Revision requests should relate to the original design brief and the agreed creative direction.
5. Changes to the Design Brief
The Client is expected to provide a clear and complete design brief before the project begins.
Minor adjustments made during the design process are considered part of the normal revision process.
However, substantial changes to the original design brief—including, but not limited to, changes to the book genre, overall concept, title, subtitle, author name, series branding, target audience, visual direction, or other core project requirements—may be considered outside the original scope of work.
Such changes may require additional design fees or may be treated as a new project, at the sole discretion of Dee Dee Book Covers.
6. Cancellation
The Client may cancel the project at any time before design work has begun without any cancellation fee.
If the project has started and the initial cover proposal (or proposals) has been presented, but the Client decides not to proceed because none of the proposed concepts meet their expectations, the project may be cancelled by either party without any payment being due.
However, once the Client has approved a design direction and requested revisions or further development of the selected concept, the project is considered approved. If the Client subsequently decides to cancel the project during the revision stage, Dee Dee Book Covers reserves the right to charge a reasonable fee to cover the design work and time invested up to the date of cancellation.
7. Project Abandonment
If the Client becomes unresponsive for more than sixty (60) consecutive days during an active project, Dee Dee Book Covers reserves the right to consider the project abandoned.
Any future continuation of the project will be subject to current availability and may require a new booking.
Project timelines will not be extended indefinitely due to prolonged periods without communication from the Client.
8. Delivery of Files
Upon receipt of full payment, the Client will receive the files included in the purchased package.
Depending on the selected package, final deliverables may include:

3D book render (JPG and/or PNG)
-
Paperback cover (JPG or print-ready PDF)
-
Other files specifically included within the purchased package
Deliverables vary depending on the package purchased.
If the Client is unsure what files are included in a particular package, they are encouraged to ask before the project begins.
9. PSD, Source & Working Files
Layered PSD files, source files, working files, editable files, and production files remain the exclusive intellectual property of Dee Dee Book Covers.
These files are not included in any standard design package.
Source files may only be purchased separately under an independent licensing agreement and are supplied solely at the discretion of Dee Dee Book Covers.
The purchase of source files does not transfer copyright ownership of the artwork unless explicitly stated in writing.
10. Ownership & License
Upon receipt of full payment, the Client receives an exclusive, non-transferable license to use the completed design for the purpose for which it was purchased, including the formats included in the selected package.
The license grants the Client the right to use the final artwork for the intended publication and related promotional purposes.
The design, artwork, or any part thereof may not be resold, sublicensed, transferred, assigned, redistributed, or reused by another individual, company, publisher, or organization without the prior written permission of Dee Dee Book Covers, except where an additional license has been purchased.
Copyright and ownership of all preliminary concepts, rejected designs, drafts, working files, and source materials remain with Dee Dee Book Covers unless otherwise agreed in writing.
11. Copyright & Intellectual Property
All preliminary concepts, rejected designs, draft files, working files, layered files, source files, production files, and other materials created by Dee Dee Book Covers remain the exclusive intellectual property of Dee Dee Book Covers unless otherwise agreed in writing.
Upon receipt of full payment, the Client receives an exclusive, non-transferable license to use the completed design for the purpose and formats included in the purchased package.
No ownership of copyright is transferred to the Client unless expressly stated in writing.
The Client may not resell, sublicense, transfer, assign, redistribute, or otherwise permit any third party to use the design without the prior written permission of Dee Dee Book Covers or where an additional license has been purchased.
12. Third-Party Assets
Book cover designs created by Dee Dee Book Covers may incorporate properly licensed third-party materials, including but not limited to stock photography, textures, graphics, brushes, fonts, or other licensed creative assets.
Copyright and intellectual property rights to these materials remain the property of their respective copyright owners.
Dee Dee Book Covers licenses such materials in accordance with the applicable license agreements and grants the Client the right to use the completed cover design only within the scope permitted by those licenses and these Terms & Conditions.
The purchase of a book cover design does not transfer ownership of any individual stock image, font, texture, graphic, or any other third-party asset incorporated into the design.
13. Stock Image Licensing
The Client acknowledges that Dee Dee Book Covers uses properly licensed stock images obtained through reputable third-party image providers, including Shutterstock and other licensed image libraries.
Unless otherwise stated, the cost of the cover design includes the Standard License applicable to the stock images used in the design.
Under the current Shutterstock Standard License in effect at the time of purchase, the permitted usage is generally limited to up to 500,000 copies, downloads, or impressions, depending on the type of product and the applicable license terms.
If the Client intends to exceed the permitted usage limits or wishes to use the cover artwork for products or purposes requiring an Extended License (including but not limited to merchandise such as T-shirts, mugs, posters, or other commercial products), the Client is solely responsible for obtaining the appropriate additional license(s) directly from the relevant stock image provider.
The Client agrees to comply with all applicable stock image license agreements.
Dee Dee Book Covers shall not be held responsible for any claims, penalties, legal actions, or additional licensing fees arising from the Client's use of the artwork beyond the scope permitted by the applicable stock image licenses.
14. Audiobook Licensing
Audiobook covers are not included in the standard eBook or print cover packages.
If the Client wishes to self-publish an audiobook edition using the cover design created by Dee Dee Book Covers, a separate audiobook license and, where applicable, the required production files must be purchased.
The audiobook self-publishing license grants the Client the right to publish and distribute the audiobook edition themselves.
This license is personal to the Client and is non-transferable.
If, at any time, another company, publisher, audiobook producer, distributor, or any other third party wishes to publish, distribute, or otherwise use the cover design for an audiobook edition, they must contact Dee Dee Book Covers directly and obtain their own license before using the artwork.
No rights are granted to any third party through the Client's self-publishing audiobook license.
15. Artificial Intelligence (AI)
The Client may not upload, submit, scan, analyze, modify, generate variations of, train, or otherwise use any artwork, concepts, draft designs, previews, or final designs created by Dee Dee Book Covers in any artificial intelligence ("AI") system or platform.
This restriction includes, but is not limited to, ChatGPT, DALL·E, Midjourney, Stable Diffusion, Adobe Firefly, Grok, Leonardo AI, Ideogram, or any current or future AI image generation, editing, enhancement, style transfer, or machine learning platform or service.
No rights are granted for AI training, machine learning datasets, style imitation, AI-assisted image generation, or any other AI-related use of the artwork without the prior written permission of Dee Dee Book Covers.
Any unauthorized use of Dee Dee Book Covers' artwork in AI systems constitutes a breach of these Terms & Conditions.
16. Client-Supplied Materials
If the Client provides photographs, illustrations, logos, fonts, graphics, or any other materials for use within the project, the Client confirms that they own the necessary rights or have obtained all required licenses and permissions. The Client accepts full legal and financial responsibility for any claims arising from materials supplied by the Client.
Dee Dee Book Covers accepts no liability for copyright infringement or intellectual property disputes relating to materials provided by the Client.
17. Font Licensing
Commercial fonts used within a design remain subject to their respective license agreements.
Unless expressly stated otherwise, font licenses are not transferred to the Client.
If the Client wishes to edit the artwork using the original fonts after project completion, it is the Client's responsibility to purchase the appropriate font licenses directly from the respective font foundries or copyright holders.
18. Colour Variations
The Client acknowledges that colours may appear differently depending on individual monitors, mobile devices, tablets, printers, printing methods, paper types, inks, and lighting conditions.
While Dee Dee Book Covers makes every reasonable effort to achieve accurate colour reproduction, exact colour consistency across all digital devices and printed materials cannot be guaranteed.
Dee Dee Book Covers shall not be held responsible for colour variations resulting from differences in display settings, printing equipment, paper stock, or printing processes.
19. Proofreading & Final Approval
The Client is solely responsible for carefully reviewing all artwork before approving the final design.
This includes, but is not limited to:

spelling;
-
grammar;
-
punctuation;
-
author name;
-
book title and subtitle;
-
series information;
-
trim size;
-
barcode placement;
-
spine text;
-
printer specifications; and
-
any other text or technical details appearing on the artwork.
Approval of the final design confirms that the Client has reviewed the artwork and accepts full responsibility for its accuracy.
It is strongly recommended that the Client orders and reviews a printed proof before approving or publishing any print edition.
The Client is responsible for providing accurate printer specifications, trim size, page count, and any other technical information required for print production.
Dee Dee Book Covers is not responsible for changes to printer templates, specifications, or file requirements introduced by third-party printers after the final files have been delivered. If such changes require modifications to previously completed files, additional design fees may apply.
20. Limitation of Liability
Dee Dee Book Covers provides professional design services with reasonable skill and care.
To the maximum extent permitted by applicable law, Dee Dee Book Covers shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from or relating to the use of its services or artwork.
This includes, without limitation:

loss of profits;

loss of sales;
-
loss of business opportunities;

reputational damage;
-
printing costs;
-
publishing delays;
-
production errors by third parties; or
-
any other financial or commercial loss.
The Client accepts full responsibility for the final use of the artwork once it has been approved and delivered.
21. Force Majeure
Dee Dee Book Covers shall not be liable for any delay or failure to perform its obligations where such delay or failure results from circumstances beyond reasonable control, including but not limited to illness, natural disasters, internet or power outages, war, governmental actions, labor disputes, technical failures, or any other event beyond reasonable control.
22. Portfolio Rights
Dee Dee Book Covers reserves the right to display completed designs on its website, portfolio, social media platforms, promotional materials, and marketing channels.
If the Client wishes to keep the design confidential until a specific cover reveal, publication, or release date, the Client must notify Dee Dee Book Covers before the final files are delivered.
Unless such a request has been made in advance, Dee Dee Book Covers reserves the right to publish the completed design upon delivery of the final files.
23. Credit
By using the final cover design, the Client agrees to credit Dee Dee Book Covers inside the book's copyright page, acknowledgements, or other appropriate location whenever reasonably possible using the following credit:

24. Governing Law
To the fullest extent permitted by applicable law, these Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Serbia.
Any dispute arising out of or relating to these Terms & Conditions or the services provided by Dee Dee Book Covers shall be subject to the exclusive jurisdiction of the competent courts of the Republic of Serbia, unless otherwise required by applicable mandatory law.
25. Changes to These Terms
Dee Dee Book Covers reserves the right to amend or update these Terms & Conditions at any time.
The most current version will always be published on this Website and will apply to all future enquiries and projects unless otherwise agreed in writing.

No separate signed agreement is required unless otherwise agreed in writing.
