Terms and Conditions

 

By contacting Dee Dee Book Covers the client agrees to the below stated terms and conditions.

AI IMPORTANT NOTICE: This is our notice that we DO NOT give permission for the usage of our cover and cover art in any AI engines or AI filters.

By contacting Dee Dee Book Covers the client agrees to abide by the terms of any license agreement for any images purchased by Dee Dee Book Covers through a third-party image provider for use in the client’s book cover design. The cost of cover design includes the STANDARD license to use stock images and is limited to a print-run of 500,000 units or sales in the case of e-books or audiobooks. For books with a run over 500,000 units, the additional license has to be purchased by the client for each stock photo that has a major role in the cover design. If clients want to use the cover design in any other way, other than eBook and paperback cover, ( to print on mugs or T-shirts, etc) , the client is responsible for purchasing Extended License. 

 

Upon receipt of final payment, the Client has exclusive, non-transferable rights to use the design for the intended use ( ebook, paperback, promotion). Artwork and design may not be resold, reused, or used out of context, or transferred to another person or a company.

Audio covers: The audio cover can be ordered separately if he/she decides to self-publish an audiobook. If another company wishes to use the design Dee Dee Book Covers created for the client, they must contact Dee Dee Book Covers and purchase the rights/artwork before using the design for their own needs that may lead to or are closely connected to getting financial or any other gain from using the artwork Dee Dee Book Covers created.

 

The client understands that he/she has no right to alter the final cover design in any way except to change the size for printing or digital display without consulting with Dee Dee Book Covers first.

 

The client agrees to abide by the terms of any license agreement for any stock images purchased by Dee Dee Book Covers through a third-party image provider for use in the client’s book cover design. The cost of cover design includes the standard license (www.shutterstock.com/license-comparison ). Images used for the client’s cover are royalty-free; however, the photographer owns the copyright to those photographs.

IT IS THE CLIENT'S RESPONSIBILITY TO MAINTAIN PROPER IMAGE LICENSING FOR ANY IMAGE USED IN THE COVER ART.
IF THE COVER IS DOWNLOADED GREATER THAN THE STIPULATED AMOUNT OR THE COVER IS USED IN A WAY THAT IS NOT COVERED WITH A STANDARD LICENSE  SO THAT THE COVER BREACHES THE STOCK PHOTO CONTRACT, IT IS AT THE CLIENT'S LIABILITY.
Dee Dee Book Covers IS NOT RESPO
NSIBLE FOR ANY PENALTIES BY STOCK PHOTO COMPANIES DUE TO LICENSING INFRINGEMENT. 

If the client supplies Dee Dee Book Covers with materials subject to intellectual property rights by a third party, the client will secure the appropriate rights to use the materials before directing the designer to incorporate them into his/her project. Should any intellectual property dispute arise involving materials the client provides, the client assumes full legal and financial responsibility.

The client is fully responsible for proofing the book cover design provided by Dee Dee Book Covers. It is strongly suggested that the client requests proof from the printer before publishing or ordering any copies of the book. At no time will Dee Dee Book Covers be held financially or legally responsible for any problems, costs, fees, or expenses incurred by the client as a result of using the book cover design.

Dee Dee Book Covers will not be held liable for incidental, indirect, consequential, special, punitive, or exemplary damages of any kind, including loss of revenues or profits, loss of business or reputation, or loss of data, in any way related to our services. Dee Dee Book Covers is not responsible for any claim, loss, or injury based on errors or any other inaccuracies appearing on our site or in our clients’ written documents, including without limitation as a result of any breach of the terms and conditions of this agreement.

Dee Dee Book Covers retains the right to use the client’s final book cover design, name, and book title in Dee Dee Book Covers’s portfolio and to market and promote our services. Dee Dee Book Covers retains copyright and ownership of all design and draft materials.

Furthermore, Dee Dee Book Covers reserves the right to accept or decline any design request, or if it happens that after numerous revisions we decide that we’re getting nowhere - to cancel the project.

By hiring Dee Dee Book Covers and using the final design, the client agrees to credit the company "Book cover design by Dee Dee Book Covers " inside the acknowledgments/copyright page of the book.

By contacting Dee Dee Book Covers, the client accepts the above-stated terms and conditions without the need for a signed agreement. It is considered that the client accepts the above-stated terms and conditions the moment he/she emails Dee Dee Book Covers.
